What is Digital Signature and why is it required?

The Information Technology Act 2000 (IT Act) prescribes digital signatures as a Means of authentication of electronic records.The IT Act has given legal recognition to digital signature meaning, thereby, that legally it has the same value as handwritten or signed signatures affixed to a document for its verification.

The Information Technology Act, 2000 provides the required legal Sanctity to the digital signatures based on asymmetric cryptosystems. The digital signatures are now accepted at par with handwritten signatures and the electronic documents that have been digitally signed are treated at par with paper documents. In short, a digital signature has the same function as that of a handwritten signature.

Why is Digital Signature necessary and where it is used?

  • A) Income Tax

    (1) In exercise of the powers conferred by section 139D of the Income Tax Act, 1961, read with clause (eebb) of sub-section

    (2) of section 295 of the Act, sub-rule

    (3) of the said rule provides that it shall be mandatory for the firms to whom provisions of section 44AB are Applicable and for the companies (other than the companies claiming exemption under section 11) to furnish the return of income electronically.

  • B) Company Law

    The Information Technology Act, 2000 provides for use of Digital Signatures on the documents submitted in electronic form in order to ensure the security and authenticity of the documents filed electronically. This is the only secure and authentic way that a document can be submitted electronically. As such, all filings done by the companies under MCA21 e-Governance programme are required to be filed with the use of Digital Signatures by the person authorised to sign the documents. Person authorize to sign the documents inter alia are Directors, Legal Representative, Chartered Accountants, Company Secretary, Bank Officials.

  • C) Tenders

    To participate in the e-tendering process, every vendor is required to use a Digital Signature Certificate.

  • D) EXIM

    Digital Signature is also required for applying Import-Export License.

  • E) Other Purposes

    There are many other purposes for which Digital Signature is used including Emails Signing, Form 16/16A signing, Documents signing, etc.

What are the Benefits of Using Digital Signature?

If the return is electronically furnished under a digital signature, the tax-payer is not required to furnish the Form ITR-V with the Income-tax Department as a follow up to the electronic transmitting of data in the return. Similarly, any return which is digitally signed by the Assessee and filed with an E-ReturnIntermediary (ERI), who, in turn, submits the return to the Income Tax Department, will also be deemed to have been filed under a digital signature of the Assesseeand no Form ITR-V is required to be submitted. In such cases, the date of electronic transmissionof the data in the return shall be the date of furnishing the return.

How do I get a Digital Signature?

The Certifying Authorities (CAs) issue Digital Signature Certificates (DSC) for electronic authentication of users. Certifying Authorities will issue Digital Signature after proper verification of records.

Class 3 signature is required by each vendor to participate in e- tendering process.Class 3 signatures are basically used in transactions where security, confidentiality and Integrity is very important because Class 3 type of signatures provide highest level of assurance within the RCAI hierarchy setup by Controller of Certifying Authorities in India

What is DGFT?

DGFT Digital Signature is used only by Importers and Exporters community. This certificate is made compulsory for all importer/exporter, who want to apply for DEPB/DES/EFT/etc. online to DGFT. Benefits of using DGFT Digital Signature: - Using this certificate they can save 50% of their license application fees more Security as compared to using a password.

Why Digital Signature is required for Provident Fund(PF) Purpose?

To attest and forward claims online, the employers are required to register Digital Signature Certificate (DSC) with EPFO. Digital Signature Certificate of class 2 and class 3 category issued by a licensed Certifying Authority (CA) need to be registered for the purpose.

Whether PAN Number is compulsory for applying Digital Signature?

PAN Card is one of the Identity proof required for obtaining Digital Signature. But I is compulsory to provided only if the Signature is required for filing of Income Tax Return and Roc Return filing.

What is the Validity of Digital Signature and can it be renewed?

Whether DIN (Directors Identification Number) is compulsory for applying Digital Signature?

No. DIN number is no compulsory for applying Digital Signature.

What is the Validity of Digital Signature and can it be renewed?

Digital Signature comes with the Validity of 1 year and 2 year and it can be renewed after the expiry.

How much time is required for processing Digital Signature?

Depending upon the completion of formalities it takes from 2 hours to 24 hours is required to process the Signature.

Can Digital Signature be carried from one place to another place?

Yes it can be carried from one place to another if it is stored in pen drive/Smartcard/Removable Disk.

It can also be stored in Token which can be used directly by attaching e-token and then kept safely for future use. It also guarantees Security of Signature and avoids any misuse.
